Please read carefully the TERMS AND CONDITIONS of using the online platform MIP - Integrated Project Management, before accessing its resources. Use of this platform and the applications that make it up signifies your agreement to the Terms and Conditions as defined below. If you do not agree to the Terms and Conditions of Use, do not use this platform. The term application, used in this agreement, refers to the MIP online platform and to the software applications, scripts and logic modules that compose it. The present terms and conditions are subject to change at any time, so please check their contents periodically for proper use.

 

1. Acceptance of the conditions

 

The online platform MIP - Integrated Project Management, is jointly managed by EMIP ASSOCIATION, fiscally identified by CIF: 47386057 and ALBADEV NET SRL, with Reg.RC No: J/1/1246/2020 and CUI: 43397967, both entities having its headquarters in Alba Iulia, str. Tudor Arghezi no. 6, Alba county, Romania (hereinafter referred to as "eMIP.ro" or "we", respectively "our"), can be accessed at the address: https://www.emip .US

Use of the platform implies full acceptance of the terms and conditions of use set forth below.

The terms and conditions may be changed at any time by the administrator of the platform, without prior notice to persons using the platform. Users will have permanent access to the terms and conditions for using the services so that they can consult them at any time. If they do not agree to the terms, users must stop accessing the platform.

 

The MIP platform, the software applications that compose it, the structure of the databases and their logical tree, are protected by copyright. Any text or graphic material that you copy, print, or download is licensed under eMIP.ro, for personal, non-commercial use only, provided you do not alter or delete the copyright notice, trademark or other proprietary notices. intellectual. If you download parts of the code / script / software from this application, including all files and images contained or generated by the application, and the adjacent data (hereinafter referred to as "Software") are considered to be licensed by eMIP.ro, exclusively for personal use and non-commercial. eMIP.ro does not transfer the title or the intellectual property rights over the application. eMIP.ro holds the full title over the application as well as all the intellectual property rights deriving from it. You do not have permission to market, redistribute or reproduce the application or parts thereof, nor to decompile it, modify its structure, disassemble the Software in a perceptible form. All trademarks and logos are owned by eMIP.ro or the licensees and you are not permitted to copy or use them in any way.

This platform is controlled and operated by eMIP.ro, from its own or rented locations that are not explicitly communicated to the beneficiaries. eMIP.ro has no obligation for the materials on this platform to be suitable or available for use in other locations outside Romania. Those who access the application from other locations do so at their own risk and are legally liable, in accordance with local law. No independent software or source code will be downloaded or exported from this application. The only ways and means aimed at exporting data from the platform are those aimed at their express use within the limits and limits stipulated in the Licensing Conditions.

 

2. Description of services

 

The MIP online platform offers its users (organizations, organizational groups, representatives and designated experts), through the management tools provided, an overview of the stage and implementation of the project (s) undergoing the licensing process, representing a means of information and communication, a useful collaboration environment of the project teams in carrying out the activities planned and carried out through the project, an efficient means of internal evaluation of the way and pace of project implementation. The platform creates, through the contribution of its users, a repository of information and deliverables, a system for archiving specific data, which can be accessed only by designated users under security controlled conditions. The main objective of the platform is to create an interactive environment for communicating and consulting the documents provided and for participating in the activities initiated by the project management team.

3. Licensing conditions

 

The beneficiaries of the use license are legal entities and can be governmental or non-governmental organizations, patrimonial or non-patrimonial, of public or private law. The licensing system of the platform aims at accessing and using its resources under three factors:

• the number of organizations included in the license;

• the maximum number of projects that will be managed under the license;

• the total number of unique users associated with the license.

In this context, the combination of the three factors (organizations, projects, users) defines the type of license purchased by the purchaser and is subject to the commercial policies of eMIP.ro. The licensing process aims to obtain access and the right to use the platform, consisting in the non-exclusive assignment of the right to use the associated software application and access it through the beneficiary's terminals, with specified browser versions: MS Edge 44.0 (or later), Firefox 2.0 (or later) and Chrome 20.0 (or later).

 

The maximum number of concurrent users (simultaneously connected to the application) is defined at the beginning of the licensing process regardless of the number of organizations participating in the licensing process. Depending on the subsequent development needs, the number of users can be changed by upgrading to the existing license.

The licensee has the obligation to provide the data necessary to initialize the platform: users, user roles (expert, partner representative, project manager, etc.), projects, etc. The level of access of the users, to the resources of the platform is managed by the beneficiary / beneficiaries of the license and is communicated in writing to the administrator of the platform at the address admin@emip.ro. After the creation of the accounts and the associated roles, the beneficiary / beneficiaries of the license have the obligation to verify them, the eventual dysfunctions being sent to the same address. The details of the access mechanism are presented in the section Access conditions.

 

The data uploaded by users in the online platform MIP, emulates in the virtual environment the projects carried out by the licensee and, as the case may be, his partners. In this context, the quality and relevance of the uploaded data affect the quality and relevance of the information exported through the predefined reports. The data are exported under conditions controlled by the licensee / beneficiaries, based on the mechanism for granting users access to the platform's resources. After exporting from the platform and downloading to users' own terminals, data, predefined reports and archives of technical documents, the use and management of sensitive information belongs to the licensee and its partners. Modifications to the reports exported by the beneficiaries are defined according to the instructions issued by the program management authority (MA) and cannot be modified by the licensee.

 

4. Access conditions

 

User access to the services and information within the platform is protected by "email address" and "password". User authentication is performed in 2 steps: a) creation of the user's account by the administrator and b) confirmation of the account by authenticating the email address of the user inside it. Our recommendation is not to disclose your access data to anyone. The platform will never ask for your access data in unsolicited messages or phone calls. Do not disclose this information to anyone who requests it. Furthermore, you are required to periodically check that access data has not been altered and to report any malfunctions to the platform's administration staff as soon as possible.

 

In order to use these services, you must:

a) communicate real, accurate, current and complete personal information and

b) to update them as often as necessary, in order to keep this information real, accurate, current and complete.

 

If you provide unreal, inaccurate, outdated or incomplete information, there is a suspicion that the information is unreal, inaccurate, out of date or incomplete. In this case, the administrator of the platform has the right to temporarily or permanently suspend your user account, after prior notice to the licensee's representative.

 

The "e-mail address" and "password" for new users will be generated by the platform administrator, according to the data provided by the licensee, based on the personal data provided during the project. As part of the e-mail confirmation mechanism, users will check and update any non-compliant or outdated personal information.

If users have not provided the minimum data required to create a "username" at the beginning of the academic year, it will be retrieved by the tutor. Users can request assistance regarding the "e-mail address" or the password at the e-mail address: admin@emip.ro. Users are required to sign messages with their full name, position, project and the name of the partner organization they belong to. The administrator has the right to archive any correspondence with the users of the platform, made via email. We recommend that you close your account at the end of each platform usage session using the appropriate button. We also advise that you close the browser window in which you worked at the end of the session.

5. Reservations and Limitations of Liability;  Other Statements

THE MATERIALS IN THIS APPLICATION ARE MADE AVAILABLE "AS IS" AND WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES. eMIP.ro DOES NOT WARRANT AND HAS NO OBLIGATION RELATED TO THE USE OR RESULT OF THE USE OF THE CONTENT OR MATERIALS IN THIS APPLICATION REGARDING THE CORRECTNESS, ACCURACY OR SECURITY OF THE INFORMATION PROVIDED.

 

TO THE EXTENT PERMITTED BY APPLICABLE LAW, eMIP.ro RESERVES ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO COMMERCIAL WARRANTIES, SUITABILITY FOR A SPECIFIC PURPOSE AND NON-INFRINGEMENT. eMIP.ro DOES NOT GUARANTEE THE ACCURACY, TOTALITY OR USEFULNESS OF THE INFORMATION CONTAINED IN THIS APPLICATION. eMIP.ro DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE MATERIALS AVAILABLE ON THIS APPLICATION WILL BE UNINTERRUPTED OR ERROR-FREE, THAT WARNINGS OR MATERIALS WILL BE CORRECTED, THAT THE APPLICATION OR SERVER WHICH I PUT THE COMPOUND. The organizations, the organizational groups, respectively the persons designated by them to operate the data and information that are the object of law no. 677/2001 with subsequent amendments and completions, for the protection of individuals with regard to the processing of personal data and the free movement of such data - bears full responsibility for the correctness of operation and compliance with the provisions of this law. eMIP.ro is not responsible for the defective operation of personal data managed by third parties. The MIP platform processes the data entered by the users, automatically, without manually intervening in the manipulations. All operations and processes performed on the platform are generated as a result of user interaction and at his request.

6. General practices regarding the use and storage / Restrictions in the use of materials

 

The platform may establish a set of general practices and limitations on the use of the services. Thus, all control / deliverable files that certify the performance of the activities will be scanned monochrome at a resolution of 150 dpi, the maximum size of a file that can be uploaded to the server is 10 MB. Also the name / name of the control files (deliverable) will be as short as possible and will not exceed 100 characters. Other constraints may be set by the management team, without changing the default file archiving structure (path).

 

7. Content

 

By this Agreement, you agree that all information - data, text, software, photographs, graphics, messages or other materials, whether publicly displayed or transmitted individually, privately, is the sole responsibility of the person who was the source of such materials. . This means that you, and not the platform, are solely responsible for all materials that you upload and make publicly available on your platform account.

 

The platform monitors, but does not control, the content transmitted, and thus does not guarantee the accuracy, integrity and quality of this content. You agree not to use the services provided by the platform to:

1. upload, post or transmit any content that is illegal, defamatory, offensive, threatening, abusive, vulgar, obscene, affects the privacy of another person, incites racial or ethnic hatred or is otherwise offensive;

2. intimidate, offend or injure other participants / members of the project team, in any way or in any form;

3. falsify or otherwise manipulate your identification data in order to disguise or conceal the origin of any content transmitted through the platform or to develop hidden pages or images (such as those that have no active link on a page of that user) ;

4. upload, post, broadcast or transmit any content for which you do not have the legal right to transmit or broadcast under any conditions, under any legal system, Romanian or foreign, contractual or trustworthy relations (such as confidential information, those under the right of ownership, under or disclosed as part of a service relationship or subject to confidentiality agreements);

5. upload, post, broadcast or transmit any type of content that infringes any patent or trademark, trade secret, copyright or other proprietary rights of any third party;

6. upload, post, broadcast or transmit any type of advertising, promotional materials, commercial offers, political information, "junk mail", "spam", chain letters, pyramid schemes or any other form of solicitation;

7. upload, post, broadcast or transmit any material that contains viruses or any other type of code, files or programs that are created to destroy, interrupt or restrict the operation of any other software, hardware or telecommunications equipment;

8. interfere with or disrupt the services / servers / networks connected to the platform or violate any requirements, procedures, policies or regulations;

9. intentionally or unintentionally violating any local, national or international law, but not limited to any lawful regulation;

10. promote or provide information on the conduct of illegal activities, promote physical or verbal harm against any group or person, or promote any act of cruelty to animals;

11. use the platform's messaging or directory as a repository to load the page, starting from a link other than the one existing in the platform, or as a way to enter another personal site.

12. to transmit, copy, disclose or improperly use personal data of any persons managed within the platform.

8. Links to other websites

 

eMIP.ro does not make any statement regarding the content of any of the sites or applications that you access outside the operated platform / network. When accessing a site or application that does not belong to the network operated by eMIP.ro, please keep in mind that the site and / or application are independent of eMIP.ro and that we or our partners do not exercise any control over the content of that site / application. Establishing a link to a site / application outside the eMIP.ro network does not imply that we assume and accept responsibility for the content or use of such web site or application. The platform is not responsible for the availability of these external sites, does not support and is not responsible for their content (advertising, products or other materials on or available on such sites).

 

9. Copyright and intellectual property

 

The platform allows the user to use a certain area to store documents for his personal use or to make them available to others. All information displayed, transmitted or contained on the platform, including but not limited to documents, articles, texts, photographs, illustrations, audio and video recordings, trademarks, service marks, are protected by copyright and copyright laws. intelectual property.

 

Regarding the structure of the databases, processes and algorithms implemented within the software application operating under the MIP brand, it is protected by copyright law and is used only in accordance with the law, based on the licensing agreement. eMIP.ro may allow the operation of the MIP platform, for commercial purposes only to the designated partners, based on a written agreement with the author. The distribution and transmission of the content may be carried out only to the extent that it is done as part of the processing or use of personal data of the user or third parties designating the user as part of the processing of personal data, under the conditions stipulated in the contract. the beneficiary of the licensing process. You agree not to modify, publish, transmit, transfer, sell, reproduce, distribute, supply, display or commercially exploit in any way any content or infringe the service mark contained in such content.

 

10. Service changes

 

The platform reserves the right to modify, reposition, remove or add portions of the applications that make it up, at any time or at certain intervals, to temporarily, permanently or permanently interrupt the services provided (in whole or in part), with or without prior notice. You agree that the platform is not liable to you or any third party or institution for any modification, suspension or discontinuance of the available services.

11. Termination of collaboration

 

You agree that the platform through its administrator may, if it deems it appropriate, block your access, use of the services or use of any other services you benefit from, or remove and delete any content from the services for any reason, including but not limited to to, the lack of use or if the platform considers that you have violated or not acted in accordance with the letter or the spirit of this agreement.

 

You agree that any termination of your access to the services provided under any terms of this Agreement may be made without prior notice, and you acknowledge and agree that the platform may deactivate or delete files and all information relating to from your personal account and / or prohibit any subsequent access to such files. Furthermore, you agree that the platform will not be liable to you or any third party in any way for prohibiting and / or deleting your account and accessing the services provided through the platform.

 

You agree that following the written request, submitted by the legal representative of the partner organization of which you are a member, to withdraw your access step (total or partial), your account will be deleted or deactivated, temporarily or permanently, without the platform to be responsible for the causes / reasons that led to this decision.

 

Upon termination of this Agreement, under the terms of the Agreement, you must immediately destroy all materials downloaded or obtained by other means using the Platform (credentials, project data, information documents and tutorials on the use of the Platform, logos - non-limiting example) and all copies of these materials, made by the terms of this agreement or by other methods.

 

12. Limitation of liability

 

By this agreement, the platform assumes no responsibility if certain information is provided late, lost, deleted, cannot be stored or accessed on our servers for any reason. The platform assumes no responsibility for the consequences that may occur due to the delay, loss or inaccuracy of information published or existing on the platform. Users will use the information provided within the platform at their own risk, and in the event of damage caused by the use of the services or information provided, users agree that the platform will be discharged of any liability.

 

13. Compensation

 

You agree to indemnify and hold harmless from any claims or claims, including legal fees or attorneys' fees, incurred by a third party or organization as a result of or arising out of the content of personal material or use of the platform's services, breach of this agreement or violation of any agreement. rights of that third party.

 

14. Violation of conditions

 

Any violation of these conditions of use will be communicated to the platform administrator at the email address admin@emip.ro.
